SCUBA LEGENDS

Please read these terms and conditions of use carefully before accessing, using or obtaining any materials, information, products or services. By accessing the Scuba Legends website (collectively “Our Website”) you agree to be bound by these terms and conditions (“Terms”) and our Privacy Policy. If you do not accept all of these Terms, then you may not use Our Website. In the Terms, “we”, “us”, “our” or “Scuba Legends” refers to Scuba Legends S.L. and “you” or “your” refers to you as the user of Our Website.

We may modify the Terms, for any reason at any time, by posting a new version on Our Website. These changes do not affect rights and obligations that arose prior to such changes. Your continued use of Our Website following the posting of modified Terms will be subject to the Terms in effect at the time of your use. We please you to review these Terms periodically for changes. If you object to any provision of these Terms or any subsequent modifications to these Terms or become dissatisfied with Our website in any way, your only recourse is to immediately terminate the use of Our Website.

Payments

We require 100% of the due price as an advance payment at the time of booking. In case of cancellation we will act according to our cancellation policy. 

Cancellations

Cancellations by customer:

Regardless of which activity was booked, if a booking consists of several days and/or participants and/or activities, the booking is deemed to have commenced with the first day of the booking. Further activities can therefore no longer be cancelled or reimbursed. 

General Bookings:

  • More than 48 hours prior to date (00:00) of the diving activity: Full refund (excl. banking and processing fees, PADI training materials and eLearning packages)
  • Within 48 hours prior to date (00:00) of diving activity: No refund

Group Bookings:

A special cancellation policy applies to group bookings of 4 or more persons:

  • More than 15 days prior to date (00:00) of diving activity: Full refund (excl. banking and processing fees, PADI training materials and eLearning packages)
  • 15 – 3 days prior to date (00:00) of diving activity: Refund 50% of total price (excl. banking and processing fees, PADI training materials and eLearning packages)
  • Within 48 hours prior to date (00:00) of diving activity: No refund

Technical Diving:

A special cancellation policy applies to all activities related to technical diving:

  • More than 15 days prior to date (00:00) of diving activity: Full refund (excl. banking and processing fees, PADI training materials and eLearning packages)
  • 15 – 3 days prior to date (00:00) of diving activity: Refund 50% of total price (excl. banking and processing fees, PADI training materials and eLearning packages)
  • Within 48 hours prior to date (00:00) of diving activity: No refund

PADI Materials & eLearning

All non-professional courses include the costs for the PADI materials and eLearning. 

  • In case of course cancellation PADI Materials & eLearning access are non-refundable.AllOnce purchased, gift vouchers are non-refundable.

Gift Voucher:

A special cancellation policy applies for the purchase and use of gift vouchers:

  • Once purchased, gift vouchers are non-refundable.
  • Gift vouchers are valid for 12 months from the date of issue.
  • Once activity dates are confirmed, cancellations or rescheduling is not permitted.

No-Show:

  • If customer does not show up punctual for the booked diving activity (or cancels on the same day) Scuba Legends will handle it as cancellation without notice and 100% payment will be required

Lateness:

  • If land or boat-based transfers are missed due to lateness of the customer, Scuba Legends has the right to reschedule the program and/or charge extra up to full price.

Bad Weather:

  • The customer has no right to cancel an activity due to rainy or cloudy weather or other activities that could interfere with the booked activities.
  • Scuba Legends chooses dive locations based on safety, weather conditions and level of experience. Therefore, a request of a specific dive site cannot be guaranteed. However, we do our best to satisfy your requests.

 

Cancellations by Scuba Legends:

  • Reservations affected by adverse weather conditions or unforeseen circumstances beyond our control will be rescheduled whenever feasible or refunded in the form of a gift voucher.
  • If a participant fails to complete the necessary theory and/or preparations as previously communicated for each training session, Scuba Legends will be unable to allow the participant to start/continue with the course. Unfortunately, refunds or rescheduling will not be possible in such situations. However, additional training sessions can be arranged at an additional cost.
  • Should a participant be unable to provide a medical statement signed by a qualified physician when mandated, it is in accordance with Spanish law that they will be precluded from engaging in the diving activity. Regrettably, neither refunds nor rescheduling will be feasible under such circumstances.
  • Scuba Legends reserves the authority to refuse diving or training services to customers under the influence of drugs or alcohol. Please note that no refunds will be issued in such cases.
Cancellations

Cancellations by Scuba Legends:

  • Cancellations made by Scuba Legends will be refunded by 100%.
  • Scuba Legends maintains the right to reschedule dives due to poor weather conditions or safety.
  • Scuba Legends has the right to deny diving or training to customers under the influence of drugs or alcohol.
  • If the customer does not carry out the required theory and/or preparations prior to training dives, Scuba Legends might refuse diving and reschedule the program, if applicable at extra costs.
Refunds

In the rare event that you need to cancel your booking, we’ll ensure a refund in line with our cancellation policy. Please note that any bank and processing fees incurred will be deducted from the total refund amount.

Kindly note that refunds cannot be issued for training materials, physical PADI materials as well as eLearning packages. The same applies to gift vouchers. Thank you for your understanding.

Courses & Certification

We wish to inform you that Scuba Legends maintains the authority to withhold certification upon completion of any course should the instructor determine that the student has not met the requisite standards and requirements. It is imperative to understand that certification cannot be guaranteed solely through payment.

Our training sessions adhere strictly to the standards set forth by the diving association, with most skills building upon one another and necessitating successful completion to progress further. Unless a private course has been arranged, if a student opts to discontinue the training or is unable to fulfill the skill requirements despite ample training and practice time, the instructor must proceed with the remaining participants to ensure the course progresses as scheduled.

As outlined in our cancellation policy, neither rescheduling nor refunds are permitted in such cases. However, additional training sessions may be arranged at an additional cost, subject to availability.

The Open Water Course is perfect for beginners and doesn’t require any previous diving experience. But if you’re not comfortable in the ocean or not sure about getting certified yet, it’s a good idea to try diving before signing up for a course. If you’re really nervous or had a bad experience before, you might want to think about booking a private course. That way, the instructor can focus entirely on helping you. Special offers

All special offers and promotions are subject to Scuba Legends and availability and can be terminated at any time. Online offers must be booked online via our website and paid in advance.

Equipment

The customer is responsible for inspecting the provided/rented equipment (all gear and materials) before use and reporting irregularities or defects to the instructor or employee in charge.

The customer bears the risk of (random) loss, destruction or damage of the equipment, from the moment of the loan to the time of the return of the equipment to Scuba Legends. If the equipment is damaged on return, the customer bears all repair costs, if the equipment can still be repaired. In the event of loss and (even accidental) destruction or damage to the equipment that cannot be repaired, the customer shall reimburse the replacement costs of the equipment.

Medical Condition

Regardless of the experience level, all participants must be medically fit & healthy for diving. Ensuring medical fitness for diving is the responsibility of each participant, and a doctor’s statement may be necessary for certain medical conditions. Therefore, prior to booking/partaking in any diving activity, it is essential to thoroughly review the medical questionnaire. Should the need for a doctor’s statement arise, adherence to the instructions delineated on the form is requisite. Subsequently, please send a PDF scan of the document via email, ideally no later than 2 days preceding the scheduled activity.

Should a participant be unable to provide a medical statement signed by a qualified physician when mandated, it is in accordance with Spanish law that they will be precluded from engaging in the diving activity. Regrettably, neither refunds nor rescheduling will be feasible under such circumstances. Please note that diving is a risk sport. Your honesty is required and particularly important for your and your buddy’s safety, but also for the welfare of our staff. Should any uncertainties regarding medical fitness persist, or should advice be warranted, please feel free to please reach our to us.

Furthermore, it is worth noting that students enrolled in professional courses such as the PADI Divemaster or Instructor course are subject to the same medical statement requirement, irrespective of their current medical condition.

Diving insurance

The Spanish law requires every diver to have a personal diving insurance. Please bring proof of your diving insurance prior to diving or contact us to sign up for a policy of our daily or long-term plans.

If you dive regularly, it might be useful to have your own annual insurance. If you already have insurance and would like to participate in technical dives or courses, better check whether technical diving is covered.

In addition to a diving insurance, we also strongly recommend a general travel insurance from your local provider to cover non-diving accidents or illnesses abroad.
